The following is the status of rulemaking of a number of specific areas that could affect accessibility of your facility, as of December 2004, as provided by the Access Board.  We work to keep up to date on all the latest regulatory changes - Federal, Model Codes, and Laws in States we work in.  Feel free to contact Endelman and Associates PLLC for any questions or clarifications.

Finished Building Elements Designed for Children's Use (S30)*   Final guidelines published as amendments to the current ADAAG (1/13/98) DOJ (Dept. of Justice) to update its AFDA standards based on the Board's guidelines.
Finished State & Local Government Facilities (S31)  Final Guidelines published as amendments to the current ADAAG (1/13/98) DOJ to update its AFDA standards based on the Board's guidelines.
Finished Telecommunications Act Accessibility Guidelines (S34)   Final guidelines published (2/3/98) FCC to issue enforcing regulations based in part on the Board's guidelines.
Finished Over-the-road Buses (S22)  Final guidelines amending ADA design requirements for these buses issued with DOT (9/28/98) none needed
Finished Play Areas  Guidelines proposed (4/30/98) for public comment.  Board has finished review of comments.  Office of Management and Budget (OMB) reviewing for 90 days. Board to publish final guidelines when approved by OMB.
Finished New ADA/ ABA Accessibility Guidelines Issued - Updates ADAAG to include guidelines for federally funded facilities (ABA).  THE NEW ADAAG IS NOT ENFORCEABLE UNTIL ADOPTED BY THE US DEPT. OF JUSTICE. Issued July 23, 2004.  USDOJ Issued Advance Notice of intent to update its ADA Standards.  A Public Comment period is open until 1/28/05.
Finished Recreation Facilities (S37) Guideline for recreation facilities (sports facilities, places of amusement, golf, and boating and fishing facilities). Board approved Final Guidelines for Recreation Facilities 3/02.  OMB has 90 days to review the Guidelines, and when approved will publish in the federal register.
Finished Electronic and Information Technology - On December 21, 2000, the Board issued final standards for electronic and information technology under Section 508 of the Rehabilitation Act.  On January 22, 2001, GSA issued a notice to adopt these standards into the Federal procurement regulations.  DOJ issues 508 survey to Federal agencies.  
Finished Recreation Areas  Final Guidelines Published on Sept. 3, 2002. Final Guidelines Published for Amusement Rides, Boating, Fishing Piers, Golf, Miniature Golf, Play Areas, Exercise Equipment, Bowling, Swimming Pools, Spas, and more.
Proposed Public Rights-of-Way  6/17/02  the Board Issued Draft of the proposed Guidelines. The Board will prepare a proposed rule based on its review of the comments received.  The proposed rule will also be made available for public comment.  
Upcoming Passenger Vessel - On November 26, 2004, the Access Board released for public review and comment, information, including draft guidelines, on its effort to address access to passenger vessels under the Americans with Disabilities Act (ADA).  The Board is developing detailed guidelines for various types of vessels that will be used to supplement the standards.
