Trends In Company Compliance Practices - Site Observation

E&A has observed that as there is increased litigation under both the Fair Housing Act and ADA, our clients have greatly increased their requests for our services during construction.  E&A typically performs one or more accessibility site observations to help assure that contractors construct in compliance with the accessibility requirements construction documents prepared by the Owner's architect / engineers.  These services are a follow-up activity to the Accessibility Design Reviews (Plan reviews) that we have previously performed.  Unfortunately, we note many significant deviations that cause large exposure to the Owner who is responsible for non-discrimination under the ADA, and to the Owner and Architect, who are responsible under the Fair Housing Act.

E&A Continues Work on the Redesign of The Cosmopolitan, Las Vegas

E&A performed numerous Accessibility Design Reviews (plan reviews) of the project for Friedmutter Group, the architects.  Now that the building, which has been topped off in construction, is under a new hotel owner and operator - Grand Hyatt, E&A is working on revision of specific areas of the building.  This is a 3000 unit condo / hotel property with extensive amenities.

Echelon and Morgans Hotels - 5 Hotel Casino Resort in Las Vegas

Although the project has currently stopped construction due to the economic slowdown, E&A had completed Accessibility Design Reviews (plan reviews) of the project for this extensive hotel casino resort property.  The project include 5000 guestrooms in 5 hotels and very extensive amenities.

bulletManage Your ADA barrier Removal Project - For our clients, for a modest licensing fee, we can make available the entire ADA Survey data for your project in an application with functions that enable entering Status fields and creating Status Reports to track your barrier removal progress.  This is a terrific tool that some of our clients have taken advantage of.

New ADAAG Issued by The Access Board on July 23, 2004

newADAAGcover1.bmp (222950 bytes)There's a new ADAAG, the technical standard for the ADA.  However, it is not yet enforceable as law until it is adopted by the U.S. Department of justice and other applicable agencies.  The revision aims to accomplish many things at once:

  1. Reorganize the document more clearly into scoping and technical standards, with numbering nearly matching the 1998 ANSI A117.1 technical document adopted by most building codes.
  2. Add technical standards for specialty building types such as Self -Storage buildings.
  3. Integrate the ADA and ABA (for public sector) into one document.
  4. Clarify many technical standards with better language, and provide information previously only in diagrams into written details.
  5. Some revised standards - some minor - other sections completely rewritten, such as Communications Systems.

Accessibility Enhancements Per Consent Decree

E&A is proud to have been approved by both the Plaintiff and a National Corporation as a neutral expert to monitor successful implementation of a settlement on accessibility.  This is a multi-year program in progress.

Fair Housing Act / Accessibility Code Compliance In Multiple States - A Major Issue

Colorado, Arizona, Hawaii, California, Nevada, Idaho, Missouri, Illinois, Michigan, Wisconsin, Texas, Florida, Oregon, Utah, Nevada, Texas, Tennessee, Louisiana, Florida, South Carolina, and Washington.

Recent apartment complex sales, refinancing, due diligence, new development and legal actions have caused greatly increased interest in FHA/ Code Compliance.  E&A is actively performing FHA/ Code Accessibility Surveys of complexes built in the last 18 years, Accessibility Design Reviews of new multi-unit housing projects for Owners, and testifying expert and consultant services for attorneys.  Our quality developer clients include: Legacy Partners, Equity Residential Properties, AvalonBay Communities Inc., Lincoln Property Company, Wood Partners, and others.

PIKE PLACE MARKET - ADA Survey of the #1 Tourist attraction in Washington State Completed

Endelman & Associates PLLC and our sub-consultant Studio Pacifica Ltd. were selected by the Pike Place Market PDA to perform accessibility surveys of the 12 buildings and 3 parking lots comprising this historic, and much alive, historic landmark.  The project is now completed.

This was a very exciting project.  Providing improved accessibility in this historic landmark and heavily used series of interconnected structures will enable scores of locals and tourists alike to enjoy the stall market and shops.  Our survey report will help the PDA determine what should be done, budget the work, and prioritize barrier removal to improve accessibility where readily achievable.
